The grievance of the petitioner in the present case is that although in terms of advertisement and as per reservation roster there were three vacant Public Distribution System Shops in Sapahi Panchayat under Turkauliya Block in Motihari District out of which two shops are for the Backward Class people, the respondent authorities have filled up only one shop of the Backward Class female. It is submitted that the name of the petitioner appears at Serial No. 2 in the category of Backward Class female and have both the vacancies would have been filled up. The petitioner would have got the license for one vacant shop.

Learned counsel for the State submits that in the nature of

Patna High Court CWJC No.5023 of 2019(2) dt.02-08-2019 2/2 the grievance raised by the petitioner the matter may be sent to the District Magistrate, East Champaran, Motihari to look into the grievance of the petitioner and take an appropriate decision thereon. In the given facts and circumstances, where this Court finds that in fact the petitioner has already brought to the notice of the District Magistrate, East Champaran vide his letter dated 05.12.2018 as contained in Annexure '5' to the writ application that only one Backward Class female seat has been filled up and the second seat has been kept vacant despite the petitioner being a Backward Class female candidate available, this Court directs the District Magistrate, East Champaran, Motihari to look into the grievance of the petitioner as contained in Annexure '5' to the writ application, consider the same and pass an appropriate reasoned order thereon after hearing all concerned.

Let the whole exercise be completed within a period of 90 days from the date of receipt/production of a copy of this order. This writ application stands disposed off accordingly. (Rajeev Ranjan Prasad, J) vats/ved U
