JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Sessions Case No. 211A of 1998 arising out of Parbatta PS Case No. 139 of 1987 (GR No. 1043 of 1987) for the alleged offence punishable under Sections 324, 307 and 34 of the Indian Penal Code.

The petitioner was earlier on bail. He however absconded and did not appear before the court leading to cancellation of bail bond in the year 2001. He was subsequently apprehended in the year 2015. Trial could not proceed because of the absence of the petitioner. From the order dated 17.9.2015, passed by the learned 4th Additional Sessions Judge, Khagaria, it seems that trial is now at the fag end.

In such circumstances, I do not consider it

Patna High Court Cr.Misc. No.47706 of 2015 (2) dt.04-11-2015 2/2 appropriate to grant the petitioner regular bail. This application is accordingly dismissed.

The petitioner will however be at liberty to renew his prayer for bail, if the trial is not concluded within a period of six months from today.
