Petitioner seeks bail in a case registered for the offences punishable under Sections 498(A), 304(B)/34 of the Indian Penal Code.
Petitioner is husband of the victim of dowry death. Petitioner is in custody since 22.02.2018. Charges have already been framed in course of the trial.
Learned counsel for the informant opposed the prayer for bail on the ground that petitioner is husband and the Doctor has found a case of throttling.
However, there is no direct evidence, so far presumption of commission of dowry death against the
Patna High Court CR. MISC. No.8078 of 2019(7) dt.19-06-2019 2/2 petitioner is concerned, petitioner is already in custody since last one and half years. He is ready to cooperate with the trial. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Phulparas Police Station Case No.303 of 2017, corresponding to G.R.No.1875 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
