The petitioner is accused in connection with Sursand P.S. Case No. 276 of 2013 registered under Sections 395 and 397 of the Indian Penal Code.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner is not named in the F.I.R. The petitioner was apprehended by the police in course of investigation and police recorded his confessional statement showing the involvement in the present case. Thereafter, in paragraph 48 of the case diary, police detailed the statement of Kasim Sah about moving of the petitioner nearby the place of occurrence, except that there is nothing against the petitioner.
Patna High Court Cr.Misc. No.50895 of 2015 (3) dt.04-02-2016 Further submission is that petitioner is accused in three other cases, but in all three cases, he is on bail and he is in custody since 23.07.2015 in present case.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Pupri, Sitamarhi, in connection with Sursand P.S. Case No. 276 of 2013. Out of two sureties, one surety must be the close relative of the petitioner.
