By the impugned order, the evidence of D.W.5 has been expunged only because D.W.5 was not present on the date fixed for further cross-examination.

After some argument, learned counsel for the petitioner seeks permission to withdraw this civil miscellaneous petition

Patna High Court C.Misc. No.689 of 2018 (2) dt.29-10-2018 with liberty to file petition before the Court below to allow further cross-examination of the petitioner, D.W.5.
