2. The petitioner apprehends his arrest in Gopalpur P.S. Case No. 779/2023, registered for the offences punishable under Sections 341, 323, 379, 325, 354, 504, 506/34 of the Indian Penal Code.
3. As per prosecution case, petitioner along with other accused persons assaulted informant's son with iron rod. It is further alleged that this petitioner dragged informant by holding her hair and tore her blouse and misbehaved with the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. F.I.R. has been lodged after delay of four days. Case and counter case. Doctor found the injury simple in nature.
Patna High Court CR. MISC. No.7296 of 2025(2) dt.13-02-2025 2/2 Petitioner has one criminal antecedent in which he is on bail.
5. Learned APP for the State has opposed the prayer for bail of the petitioner.
6. Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court of Judicial Magistrate, 1st Class, Patna in connection with Gopalpur P.S. Case No. 779 of 2023, subject to the conditions laid down under section 438 (2) of Indian Penal Code.
