The petitioners seek regular bail in connection with Pandaul P.S. Case No. 178 of 2021 instituted for the offences punishable under Sections 302 and 304(B)/34 of the Indian Penal Code.
The learned counsel for the petitioners submits that petitioners are in custody since 10.09.2021, the charge-sheet has been filed and have no criminal antecedent.
The prosecution case in short is that all the named
Patna High Court CR. MISC. No.7982 of 2022(2) dt.16-06-2022 2/3 accused persons killed his sister by strangulation. The learned counsel for the petitioners submits that the petitioner no. 1 is Gotini of the deceased and petitioner no. 2 is neighbour of the in-laws of the deceased which itself shows that false and concocted story of strangulation has been alleged against all the accused persons.
It is further submitted that the allegation against the petitioners that they strangulated the deceased which was not correct and said story by the informant to involve the petitioners deceased in-laws and family members.
It is further stated that post-mortem report of the deceased was done on 09.09.2021 by the team of doctors and in their opinion, death was due to asphyxia, caused by hanging while in the fard beyan it has been alleged that all the accused persons have strangulated the deceased. It is further submitted that petitioners are in custody since 10.09.2021 and chargesheet has been submitted.
The learned Additional Public Prosecutor vehemently opposes the prayer for bail.
