Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 324, 307, 354(A), 379, 504, 506/34 of Indian Penal Code.

As per prosecution case, allegation against this petitioner is of commission of assault to the son of the informant by means of lathi.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is next submitted that though there is allegation of assault by means of lathi but there is no injury report on the record. Specific accusation of assault is against other co-accused persons, namely, Ramesh Yadav and Amlesh Yadav. Petitioner

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1, Madhepura in connection with Shankarpur P. S. Case No. 127 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
