The petitioner apprehends his arrest in connection with Complaint Case No.155 of 2018, registered under Section 498(A) of the Indian Penal Code and Section 3 / 4 of the Dowry Prohibition Act.

The accusation is of torturing of the daughter of the informant due to non-fulfillment of demand of dowry and removing her from matrimonial house along with her child after snatching her personal belongings.

Patna High Court CR. MISC. No.9727 of 2019(3) dt.09-05-2019 2/2 Learned counsel for the petitioner submits that, in fact, daughter of the informant left her matrimonial house and started residing in her myaka. Thereafter, Matrimonial Suit No. 37 of 2018 under Section 13 of the Hindu Marriage Act has been filed by the petitioner against his wife, daughter of the informant in the Court of Principal Judge, Family Court, Jamshedpur in which she has already been appeared and filed her W.S. Further submission is that after knowing about the said case, the daughter of the informant filed the present case.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Rohtash at Sasaram in connection with Complaint Case No. 155 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
