2. The petitioner apprehends his arrest in connection with Kahalgaon P.S. Case No. 199 of 2023, registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.
3. As per allegation, the QRT team was escorting near Railway Track and saw 6-7 anti social elements were loading coal from the side of Railway Track. On seeing the QRT team and CISF, the accused persons fled away, leaving the motorcycle on the spot. The local persons disclosed the name of accused person as Ganwal Mandal. The weight of seized coal was 500kg.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. There is nothing against him in the entire investigation.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S. Case No. 199 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C. (i) After accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner. If if is found that he is involved in any other case except the present one, his bail bond shall liable to be cancelled.
