JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-10-2015 The trial court has sought three months time for disposal of Brahampura P.S. Case No. 217 of 2011 corresponding to Trial No. 01 of 2014.
It would appear from perusal of order dated 28.01.2015 that this court directed the trial court to conclude the trial preferably within six months from the date of communication of aforesaid order even at the risk of proceeding on day to day basis. The report of learned trial Judge does not disclose as to when the order dated 28.01.2015 was received in his court and why the learned court below failed to comply with the direction of this court, particularly, in the circumstance when this court directed the trial court to take up the trial of aforesaid case on day

It would appear from the report of learned court below that still four prosecution witnesses have been left to be examined. It would further appear that at the time of passing order dated 28.01.2015 only two witnesses were examined and therefore, it is apparent that from 28.01.2015 to the date of report only two prosecution witnesses could be examined.
However, three months more time is granted to the trial court to conclude the trial of aforesaid case, failing which the matter shall be viewed seriously.
