JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 03-05-2019 Petitioner in the present case is seeking a direction to the respondents to make an enquiry in the matter of grant of licence of the Public Distribution System Shop in Gram Panchayat-Raj Bir Chapara, pursuant to the advertisement dated 30.11.2017 issued under the signature of the District Magistrate, East Champaran at Motihari. The allegations have been made against the merit list prepared for that purpose and a further prayer has been made to direct the respondents to grant the licence of dealership to the petitioner for Ward Nos.4 and 5. In Paragraph No. '13' of the writ application a statement has been made that the petitioner has given

Learned counsel for the State submits that the writ application may be disposed of with a direction to the District Magistrate, East Champaran at Motihari (Respondent No.2) to consider the representation of the petitioner, if any submitted with him and to pass an appropriate order thereon. Considering the facts and circumstances of the case as also the averments made in the writ application, this Court directs the District Magistrate, East Champaran at Motihari (Respondent No.2) to consider the representation of the petitioner, if any pending with him within a period of 60 days from the date of receipt/production of a copy of this order.

In case the petitioner wants to substantiate his representation or to file a fresh representation, he will be at liberty to do so within a period of 15 days from today and on the petitioner filing a fresh representation, the same will be considered and disposed of in the aforesaid manner.
