The petitioner apprehends his arrest in Barari P.S. Case No.261 of 2020, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. The petitioner along with other FIR named co-accused persons cheated the informant and his family members in the name of providing ground loans to them.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. No specific allegation is alleged against the petitioner. The petitioner has got no criminal antecedent as stated in para 3 of the bail petition. It is further submitted that the petitioner is ready to deposit Rs.5,000/-, Rs.10,000/- and Rs.10,000/- in the account of the informant, informant's brother and informant's mother

Learned counsel for the State opposed the prayer for anticipatory bail of the petitioner and submits that the petitioner and other FIR named co-accused persons cheated the informant and his family members.

Having considered the fact that the petitioner is ready to deposit Rs.5,000/-, Rs.10,000/- and Rs.10,000/- in the account of the informant, informant's brother and informant's mother respectively, let petitioner, above named, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, V, Katihar in connection with Barari P.S. Case No.261 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The learned court below is directed to accept the bail bond of the petitioner after verifying the fact that the petitioner has deposited the aforesaid amount in the account of the informant, informant's brother and informant's mother.
