The petitioner is languishing in custody since 22.2.2018 in a case registered for the offence punishable under Section 392 of the I.P.C.

The prosecution case is that on robbery of the motorcycle of the informant, case was lodged against unknown. Name of the petitioner sprang up on the confession of co-accused Abhimanyu Kumar Mahto who suggested that robbery of motorcycle was committed by him, along with the co-accused Sonu Kumar and the petitioner Raju Kumar Sahni. It is submitted by learned counsel for the petitioner that recovery has not been made from the possession of the petitioner. It is further submitted that co-accused Abhimanyu Mahto Mahto has been granted bail by a co-ordinate Bench of

Patna High Court Cr.Misc. No.11041 of 2019(2) dt.25-02-2019 2/2 this Court vide order dated 13.8.2018 passed in Cr. Misc. No.45123 of 2018. The petitioner is accused in two other cases. Learned APP submits that the name of the petitioner sprang up in the confessional statement of co-accused and the petitioner is having criminal antecedent.

Considering the fact that the investigation has already been concluded, the co-accused have been granted bail by coordinate Bench of this Court and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Amnaur P.S.
