JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-04-2018 The learned counsel for the petitioner submits that though the petitioner has filed an appeal before the respondent no.6 with a copy to the respondent no.5 but the appellate authority is the respondent No.5, hence the petitioner be permitted to file a fresh appeal before the respondent No.5.
In view of the aforesaid, the present writ petition is disposed of with a direction to the petitioner to file an appeal before the respondent No.5 within a period of 03 weeks from today and in case, such an appeal be filed within a period of 03 weeks from today, the respondent no.5 shall consider the same on
Patna High Court CWJC No.7324 of 2018 (2) dt.20-04-2018 2/2 merits and dispose of the same within a period of four weeks thereafter by a reasoned and speaking order after giving an opportunity of hearing to the petitioner. It is needless to state that the appeal shall be examined on merits without considering the issue of limitation.
