Petitioners seek regular bail in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition & Excise Act.
As per the prosecution case, 64.500 liters of foreign liquor has been recovered from a Maruti car of which petitioner No.1 was driver and petitioner No.2 was cleaner. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioners and they are no way
Patna High Court CR. MISC. No.7840 of 2022(2) dt.08-04-2022 2/2 concerned with the alleged recovery. Petitioners were not aware of the nature of consignment transported by the vehicle and they were only following the instructions of the owner of the vehicle. Petitioners claim clean antecedent are in custody since 05.01.2022 and 07.12.2021 respectively and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Court No.2, Bhagalpur in connection with Sabour (Goradih) PS case No.311/2021.
