ANJANA MISHRA ORAL ORDER 2 04-11-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody since 22.11.2014 in connection with Deoriya P.S. Case No. 110 of 2014 registered for the offences punishable under Sections 121(K)/122/ 123/ 120(B)/ 414 of the Indian Penal Code and Section 3⁄4 of the Explosive substance Act and 16 (Kha)/18/19/20 of the U.A.P.A. Act. Earlier prayer of these petitioners for bail was rejected vide order dated 25.05.2015.

Learned counsel for the petitioners submits that similarly situated persons whose case has also been rejected has been granted regular bail subsequently vide order dated 09.09.2015

Patna High Court Cr.Misc. No.47893 of 2015 (2) dt.04-11-2015 P2/2 passed in Cr. Misc. No. 41894 of 2015 and that the case is that of identical nature to that of said Dilip Paswan. Considering the facts and circumstances and also the period of custody, let the petitioners abovenamed, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Sessions Judge-cum-Spl. Judge, Muzaffarpur in connection with Deoriya P.S. Case No. 110 of 2014.
