JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-01-2016 Heard the learned counsel for the petitioner, the learned A.P.P for the State as also the learned counsel for the Informant.

The petitioner seeks bail in a case for the offences punishable under sections 379 and 420 of the I.P.C Allegedly, the A.T.M card of the informant Manju Singh was taken away by unknown after giving another A.T.M. to her and thereafter from her account money was got transferred. During investigation it transpired that by three transactions amount of Rs. 34,000/- was transferred from the account of Manju Singh to the account of the petitioner through A.T.M. Submission is of false implication and that the petitioner is poor young labour, one unknown person has taken away the A.T.M. card of the petitioner by giving another A.T.M.

Patna High Court Cr.Misc. No.48864 of 2015 (5) dt.29-01-2016 2/2 card to him when he went to withdraw the amount and it appears that unknown fellow got transferred the amount from the account of Manju Singh in the account of the petitioner and some amount has also been withdrawn. However, the petitioner is ready to return back the amount of Rs. 34,000/- to the informant after his release within three months.

The learned A.P.P. and the learned counsel for the informant on that ground do not oppose the prayer for bail. In the facts and circumstances as stated above, the petitioner is directed to be released on provisional bail for three months on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Madhubani in Madhubani Town P.S. Case No. 174 of 2015/ G.R. No. 1015 of 2015 and if the petitioner deposits the amount of Rs. 34,000/- through Bank draft in the name of the informant Manju Singh within said period then the provisional bail granted to the petitioner shall be confirmed by the learned court below itself and the Bank draft so deposited shall be given to the informant after due verification.

Accordingly, this Criminal Miscellaneous is hereby disposed of.
