The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 307, 385, 504, 506 and 341 of the Indian Penal Code.

The prosecution case in short is that the accused persons demanded money from the informant as extortion and on denial, he was badly assaulted by them.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.9.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. There is admittedly land dispute between the parties. A title suit

Patna High Court CR. MISC. No.9158 of 2019(5) dt.10-04-2019 2/2 is also pending in that regard. The petitioner is alleged to have given a khanti blow on the head of the victim. The nature of injury is said to be grievous. It is further submitted that the petitioner may be released after completion of nine months of custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that after completion of nine months of custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional District & Sessions Judge, Bhagalpur in connection with Kahalgaon P.S. Case No. 420 of 2016.
