The supplementary affidavit filed by the petitioner is taken on record.

This is the second attempt on behalf of the petitioner for grant of regular bail in connection with Sakra P.S. Case No.141 of 2022 registered for the offence under Section 302 of the Indian Penal Code.

Earlier, the bail application of the petitioner was rejected vide order dated 14.07.2023 passed in Criminal Miscellaneous No.41523 of 2023.

The petitioner is accused of committing murder of the deceased. The F.I.R. was registered against

Patna High Court CR. MISC. No.12895 of 2024(2) dt.20-03-2024 2/3 known. The petitioner has been made accused in the case subsequently on the basis of his confessional statement of coaccused Nitish Kumar @ Nitesh Kumar. 6.

The petitioner's name has come in the confessional statement of co-accused Nitish Kumar @ Nitesh Kumar, who has been granted bail by this Court vide order dated 05.03.2024 passed in Criminal Miscellaneous No.80856 of 2023. The petitioner is in custody since 19.11.2022. He is a student of Business Management in Muzaffarpur. 7.

Considering the aforesaid facts and also the period of custody of the petitioner, this application is allowed. 8.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II, Muzaffarpur, in connection with Sakra P.S. Case No.141 of 2022.

This is subject to the condition that petitioner shall mark his attendance in Baligaon Police Station, DistrictVaishali on first and third Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.
