Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.
It is alleged that all the accused persons named in the FIR including these petitioners have assaulted sons of the informant with lathi, rod and danda.
Learned counsel for the petitioners submits that the petitioners are innocent and has falsely been implicated in this case and no such occurrence took place as alleged by the prosecution. There is general and omnibus allegation against the
Patna High Court CR. MISC. No.9408 of 2023(2) dt.25-04-2023 2/2 petitioners. FIR has been lodge after a delay of three days. Petitioners claims clean antecedent.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-Ist Class, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 335 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
