The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered under Sections 341, 384, 354, 379, 506 of the Indian Penal Code.

Allegation is that the petitioner used to tease the grand daughter of the informant and also took her mobile. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.16507 of 2020(2) dt.09-12-2020 2/2 present case. An informatory petition was filed by the petitioner prior to institution of the present case. There is a case and counter case between the parties. All offences are triable by the Magistrate.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge III, Gopalganj in connection with Hathua P.S. case No.201 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
