The petitioner seeks bail in a case under Section 456, 376, 380/34 and other sections of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected vide order dated 20.03.2015 passed in Cr. Misc. No. 2921 of 2015.
A report was called for from learned trial court about the stage of trial. The learned 2nd Additional Sessions Judge, Madhubani has reported that three prosecution witnesses have already been examined and the trial is likely to conclude within six months.
It is submitted that the prosecutrix has already been examined and she did not support the prosecution case. From the
Patna High Court Cr.Misc. No.51592 of 2015 (3) dt.27-04-2016 2/2 perusal of cross-examination of prosecutrix, it would appear that she is a lady of easy virtue.
Considering the nature of accusation, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
The learned court below is directed to hold the trial on day to day basis and conclude the same, preferably, within three months from the date of receipt of this order. (Prabhat Kumar Jha, J) BKS/- U T
