The petitioner seeks bail in a case registered for the offences under Section 376 and other sections of the Indian Penal Code.
The informant alleged that Bhukhali Khatoon took her to the house of Nurul Hassan and Nurul Hassan committed rape on her.
Submission of the petitioner is that the petitioner is not named in the F.I.R. The informant named the petitioner in her statement under Section 164 of Cr.P.C. and disclosed that the petitioner came to the bus stand when she fled away from the house of Nurul Hassan and tried to take her back. It appears that there is no allegation against the
Patna High Court Cr.Misc. No.45039 of 2014 (2) dt.18-02-2015 2/2 petitioner that she in any way committed any offence with the victim and for that the petitioner has remained in jail since 19.8.2014.
Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on her furnishing bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sandip Singh, learned Judicial Magistrate, Purnea, in connection with Banmankhi P.S. Case No.203 of 2014.
