The petitioner is languishing in custody since 20.10.2018 in connection with Town P.S. Case No.729 of 2018 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and 25 (1-B)a, 26, 35 of the Arms Act. Prosecution case as per the FIR is that on 18.10.2018 at 5.30 P.M., the informant, S.I., Nagendra Sahani of Town P.S. received an information to the effect that some miscreants are sitting in a house near the Sadar hospital and preparing to commit dacoity and consequently, laid a raid and three persons including the petitioner were apprehended from the spot and from the possession of the petitioner, one loaded country made

Patna High Court CR. MISC. No.9776 of 2019(2) dt.26-03-2019 2/2 pistol and cartridge were recovered and from possession of apprehended co-accused, Awadhesh Mali, a knife was recovered.

It is submitted by learned counsel for the petitioner that the investigation has already been concluded and petitioner is accused in one other case apart from the present case, in which, he is on bail.

Considering the nature of accusation and the period of custody and the fact that the investigation has already been concluded, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Town P.S.
