2. The petitioner has preferred this application for grant of regular bail in connection with Hajipur Town P.S. Case No. 1059 of 2024 dated 12.12.2024 registered for the offences punishable under Sections 126(2), 115(2), 109, 324(4) and 352 of B.N.S. and Section 37 of the Bihar Prohibiton and Excise Act.

3. As per the prosecution case, the informant alleges that when he went to market on his scooty, a motorcyclist came in a drunken state and blocked the road. Thereafter, the motorcyclist started abusing and hit him on the head with a big stone with intention to kill the informant due to which he fell

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. It is further submitted that the petitioner was going slowly and carefully on the road by his motorcycle as there was a crowd, in the meantime, the informant came there on scooty with rash and negligent manner and while overtaking to the petitioner's motorcycle, the informant slipped on the road which caused him injury. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 14.12.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Hajipur Town
