2. The petitioner is in custody since 03.09.2014 in connection with Bathnaha P.S. Case No.169 of 2014 for the offence alleged under section 394 of the Indian Penal Code.

3. It is submitted that the petitioner is not FIR named accused and no incriminating article whatsoever has been recovered from his possession. He has been implicated only on the basis of confessional statement of co-accused Brij Mohan Sah.

4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner (Sohan Thakur) be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Bathnaha P.S.

Patna High Court Cr.Misc. No.44118 of 2014 (3) dt.03-03-2015 2/2 Case No. 169 of 2014 with additional condition that the petitioner shall remain personally present on each and every date during the trial and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled by the Court concerned.
