The petitioner apprehends his arrest in connection with Town P.S. Case No. 423 of 2015 registered under Sections 341, 323, 379 of the Indian Penal Code and section 3(1) (x) (xi) of S.C./S.T. (prevention of atrocities) Act.
The accusation is that the petitioner along with 4-5 surrounded the informant Varun Kumar in the way and started to assault and abuse him by denoting his caste name Passi and at that time, gold locket and cash of Rs. 1600/- of the informant was snatched.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.47084 of 2015 (3) dt.27-01-2016 2/2 petitioner submits that petitioner and informant are co-villager. In fact, one Vijay Kumar Sharma had filed Complaint Case No. 1415 of 2015 on 05.06.2015 in the Court of C.J.M., Muzaffarpur in which informant of the present case is one of the accused and the present petitioner is witness in that complaint case. Due to that reason, informant has lodged this present case with false allegation. Moreover, informant has settled the dispute by filing the compromise petition in the Court of C.J.M., on 21.12.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Muzaffarpur in connection with Town P.S. Case No. 423 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
