JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Rafiganj PS Case No. 19 of 2012 for the alleged offences punishable under Sections 147, 148, 149, 427, 435 of the Indian Penal Code, Sections 3, 4 and 5 of the Explosive Substance Act, Section 27 of the Arms Act and Section 17 of the C L A Act. Learned counsel for the petitioner submits that he was not named in the First Information Report and he has been implicated in the case on the basis of confessional statement of coaccused Mritunjay Mishra. Referring to Annexure-2 of this application, learned counsel for the petitioner submits that said Mritunjay Mishra has been granted bail by an order dated 20.7.2015 passed in Cr. Misc. No. 25175 of 2015. Considering the submission made on behalf of the

Patna High Court Cr.Misc. No.47674 of 2015 (2) dt.04-11-2015 2/2 petitioner, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge V, Aurangabad, in Rafiganj PS Case No. 19 of 2012.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
