The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 506 and other sections of the Indian Penal Code and Sections 27/35 of Arms Act.

As per the prosecution case, co-accused Santosh Yadav caused fire arms injury to the brother of the informant as a result of which he died on the spot.

Learned counsel for the petitioner submits that, the petitioner has been falsely implicated in this case. As per the FIR, there is general and omnibus allegation of assault against the petitioner and no specific overt act has been alleged against the said petitioner. The petitioner and the informant are covillagers and due to village politics, name of the petitioner has

Patna High Court CR. MISC. No.8099 of 2022(3) dt.15-09-2022 2/2 been implicated in this case. Similarly situated co-accused Majjo Yadav has already been granted anticipatory bail by this court in Cr.Misc.No. 10408 of 2022.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Munger in Muffasil Police Station Case No. 329 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
