ANJANA MISHRA ORAL ORDER 12-08-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Shankarpur P.S. Case No.108 of 2013 for allegedly having committed the offence under Section 302 of the Indian Penal Code and Section 3(2)(v) of the S.C./ST Act. Learned counsel for the petitioner submits that neither the petitioner is named in the F.I.R. nor any case is made out against him under the relevant provisions of the S.C./ S.T. Act so as to attract the said provisions. It is further submitted that the main allegation is against one Ankur Kumar and not against this petitioner.

Considering the entire facts and circumstances and

Patna High Court Cr.Misc. No.26148 of 2016 (3) dt.12-08-2016 2/2 also the fact that co-accused Ankur Kumar @ Anku Kumar has been extended the privilege of regular bail, vide order dated 5.2.2016, passed in Cr.Misc. No.228 of 2016 and another coaccused Pawan Kumar @ Pawan Yadav has also been extended the privilege of anticipatory bail, vide order dated 20.4.2016, passed in Cr.Misc. No.14398 of 2016, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Shankarpur P.S. Case No.108 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
