This application for grant of regular bail arises out of Kotwali (Barari) P.S. Case No. 637 of 2014 disclosing offences under Sections 302, 201, 120B/134 of the Indian Penal Code and 3(ii) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), Act, 1989.

Learned counsel for the petitioner submits that he was not named in the First Information Report and his name surfaced on the basis of confessional statement of some of the coaccused. He has referred to an order dated 02.09.2015 passed by this Court in Criminal Miscellaneous No. 18199 of 2015 and

Patna High Court Cr.Misc. No.47656 of 2015 (2) dt.04-11-2015 2/2 Criminal Miscellaneous No. 11244 of 2015. He submits that similarly situated co-accused have been granted regular bail by this Court.

In view of the submission as above, this application is allowed.

Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 637 of 2014.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
