JUSTICE SUDHIR SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The bail application of the petitioner was earlier rejected vide Cr. Misc. No. 16431 of 2015 dated 10.06.2015 with liberty to renew the prayer for bail after completion of one year in custody. The petitioner is in custody since 21.09.2014. He has remained in custody for more than one year.

The prosecution story, in brief, is that on the date of occurrence, the daughter of the informant, namely, Guriya Kumari, aged about 6 years, had gone to natural call in the field outside from the house, and in course of returning, the petitioner committed rape forcibly with her, who became unconscious, and when she came in consciousness, she returned home weeping and

Considering the period of custody and earlier observation made in the order dated 10.06.2015 passed in Cr. Misc. No. 16431 of 2015, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. Ist Katihar, in connection with G.R. No. 2945/2014 (Korha P.S. Case No. 171/2014).
