Prayer of the petitioner is to direct the respondent no. 4 to register a First Information Report against respondent no. 5. Mr. Ruchikar Jha, learned AC to SC-8 submits that on bare perusal of the writ application, it would appear that the petitioner has never approached the police station for lodging of the First Information Report. This Court finds from the writ application that in paragraph '15' of the writ application, the petitioner has stated that he had sent a representation to the
Patna High Court CR. WJC No.1329 of 2018(2) dt.20-12-2022 2/2 Senior Superintendent of Police, Muzaffarpur and the Officerin-Charge of Sadar Police Station, Muzaffarpur, but thereafter there is no statement that the petitioner had followed the further procedure, if the police was not lodging the complaint. It seems that the petitioner has moved this Court directly for lodging of the F.I.R. even otherwise nobody has appeared to press this application.
This application is dismissed.
