This application is for grant of regular bail in connection with Brahmpur P.S.case No.505 of 2019 for the offences under Sections 147, 148, 149, 323, 341, 353, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act. Police had gone to arrest petitioner no.2 but the other accused persons including the petitioner no.1 attacked the police party and tried to snatch the arms and also get freed petitioner no.2 Submission of the learned counsel for the petitioners is that as the police was in civil dress, they have not identified them and apprehending them kidnapper, they attacked the police force. Petitioners are in custody for more than four months.

Heard learned A.P.P., who has opposed the prayer

Patna High Court CR. MISC. No.9050 of 2020(2) dt.03-03-2020 2/2 for bail on the ground that petitioner no.1 is accused in two other cases and the petitioner no.2 is accused in five other cases. Having heard both sides and considering the allegation as well as conduct of the petitioner no.2 (Ramesh Yadav) as well as his antecedent, I am not inclined to grant bail to him at this stage, however once the charge is framed, he is at liberty to renew his prayer for bail.

So far petitioner no.1 (Deepak Yadav) is concerned, let the petitioner no.1, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Brahmpur P.S.case No.505 of 2019.
