JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Haspura P.S. Case No. 171 of 2019, registered for offences punishable under Sections 354(A)(B) of the Indian Penal Code and Section 8/12 of POCSO Act.
Allegation against the petitioner is of getting the minor daughter of the informant and when she started crying, the petitioner let her go.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and as the daughter of informant was plucking guava and when the petitioner asked not to do so, a dispute arose between the parties and due to which, he has been made accused in this case and no allegation of rape or any other overt act has been levelled. Learned counsel for the State opposed the prayer for bail on the ground that the girl is minor.
Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I-cum-Special Judge (POCSO), Aurangabad, in connection with Haspura P.S. Case No. 171 of 2019.
