The petitioner is in custody in connection with Kudhani (Turki O.P.) P.S. Case No. 582 of 2019 for the offenses under Sections 399, 402, 413, 414 and 34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case it is alleged that, on search in a shiv temple, three motorcycles without number plates and magazine with 7.65 bore pistol were seized. Nothing was recovered from the conscious possession of the petitioner. The petitioner is in custody since 05.09.2019.
