The petitioner apprehends arrest in a case registered for the offence punishable under sections 376/511/506 of the Indian Penal Code.
As per the prosecution case, the petitioner attempted to molest the informant on the point of pistol. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as he happens to be neighbourer of the informant and there is land dispute between them. Petitioner claims clean antecedent.
Learned counsel for the State as well as the informant oppose the prayer for bail.
Considering the aforesaid facts of the case, prayer for
Patna High Court CR. MISC. No.10415 of 2023(3) dt.19-06-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of M/s Payal Singh, Judicial Magistrate, Patna city in Daniyawa Police Station Case No. 136 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
