The petitioners seek bail in a case registered for the offence under Section 302 and other sections of the Indian Penal Code and Section 27 of the Arms Act.
The informant alleged that while he along with Hazari Mahto was going on motorcycle, some persons started
Patna High Court Cr.Misc. No.45056 of 2014 (2) dt.18-02-2015 2/3 indiscriminate firing. Hazari Mahto died on the spot and the informant got firearms injury on different parts of his body. The informant further alleged that Hajari Mahto had dispute with these petitioners, Satish Kumar and Munna Thathera. The informant suspected the hands of the aforesaid persons in the firing.
Learned counsel for the petitioners submits that except the suspicion, there is no tangible material to show that the petitioners made firing killing Hazari Mahto. It is further submitted that co-accused Satish Kumar has already been enlarged on bail.
Learned A.P.P., however, has opposed the prayer for bail.
It appears that on mere suspicion, the names of the petitioners figured in the case and on same and similar allegation co-accused Satish Kumar has already been granted, vide order dated 30.1.2015 passed in Cr.Misc. No.731 of 2015. Considering the aforesaid facts, the petitioners, named above, are directed to be enlarged on bail on furnishing bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City, in connection with
Patna High Court Cr.Misc. No.45056 of 2014 (2) dt.18-02-2015 3/3 Alamganj P.S. Case No.221 of 2014.
