NILU AGRAWAL ORAL JUDGMENT (Per: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI) Date: 19-01-2017 The order dated 14.1.2016 passed in O.A. No. 32 of 2016 by the Central Administrative Tribunal, Patna Bench, Patna is under challenge in the writ application.
The Tribunal while rejecting the O.A. application has observed that the claim of compassionate appointment was being made for the first time after ten years which defeats the object and purpose of grant of benefit of compassionate appointment which is to provide immediate relief to the distressed family. Counsel for the respondent-railway also points out to
Patna High Court CWJC No.4539 of 2016 dt.19-01-2017 2/2 the Court that though the father of the petitioner was injured while performing his duty in the year 2004, his death happened in the year 2006 and he superannuated in the year 2005. Therefore, it was not a case of death in harness.
These are good enough grounds to not to interfere with the order of the Tribunal.
