JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 Petitioner seeks regular bail in connection with Bettiah Town P.S. Case No. 751 of 2019 registered for the offence(s) punishable under Section(s) 413/414/34 of the Indian Penal Code and Section(s) 25(1-b)a/26/35 of the Arms Act. Petitioner was apprehended along with a motorcycle and he could not produce the paper of the same. Apart from that he is accused in one more case also.

Submission of the learned counsel for the petitioner is that four persons were arrested and he has falsely been made accused in this case on the allegation that recovery is from him. He is in custody since 15.10.2019.

Heard learned A.P.P. and perused the impugned order from which it appears that there was a recovery of country-made

Patna High Court CR. MISC. No.6999 of 2020(2) dt.06-02-2020 2/2 loaded pistol and a live cartridge from the possession of the other accused persons and it further appears that they earlier stolen 10 motorcycles and sold some of them to some other persons.

Having heard both sides, considering the nature of allegation, I am not inclined to grant bail to the petitioner at this stage. However, once charge has been framed, petitioner is at liberty to renew his prayer for bail.
