JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Suppi P.S. Case No. 366 of 2022, registered for offence punishable under sections 414, 272, 273 of the Indian Penal Code and section 30 (a) of the Bihar Prohibition and Excise Act. The police intercepted a four wheeler followed by a motor cycle. 917.7 litres of illicit liquor was recovered from that vehicle and from the motor cycle, which was driven by the petitioner, 36 litres of Nepali saufi wine has been recovered. The learned counsel for the petitioner has submitted that the petitioner is innocent and he is under custody for a period of six months.

No.13345 of 2023(2) dt.17-05-2023 2/2 Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-I, Sitamarhi in connection with Suppi P.S. Case No. 366 of 2022, subject to the following conditions:- (i) Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other cases except the present one and the cases mentioned in paragraph no. 3 of the bail petition, his bail bond shall not be accepted. (ii) The petitioner shall remain present physically before the court below on each and every date till framing of the charge and his failure to physical appearance shall lead to cancellation of his bail bond.
