JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-11-2021 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor on behalf of the State. In this case, the petitioner apprehends his arrest in connection with Complaint Case No. 1036(C)/2019 registered for the offences punishable under section 498(A) of the Indian Penal Code and sections 3/4 of the Dowry Prohibition Act, 1961. Learned counsel for the petitioner has submitted that both the parties have decided to end their dispute and live separately. In this connection, a petition for decree of divorce on the basis of mutual consent has been filed in Divorce Case

Patna High Court CR. MISC. No.9319 of 2020(3) dt.02-11-2021 2/2 No.218/2020 by the opposite party no. 2. Similarly a compromise petition has also been filed in Complaint Case No.1035(C)/2019. The certified copy of the compromise petitions have been furnished by the learned counsel for the petitioner. It has further been submitted that the orders in the case of both the parties on the basis of compromise are still awaited.

Learned Additional Public Public has opposed the prayer for bail.

Considering the fact that the matter is going to be settled between the parties, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Complaint Case No. 1036(C)/2019, subject to condition as laid down under section 438(2) Cr. P.C.
