The petitioner seeks bail in connection with Nathnagar (Madhusudanpur) P.S. Case No. 690 of 2018 dated 12.11.2018 instituted for the offence under Section 366(A) of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide order dated 27.09.2019 passed in Cr. Misc. No. 42756 of 2019. The petitioner is alleged to have taken away the daughter of the informant for the purpose of marrying her.

In the present petition, the learned counsel for the petitioner has harped upon the period of custody of the petitioner and about no progress in the trial.

Patna High Court CR. MISC. No.10457 of 2020(3) dt.03-07-2020 2/3 It appears that the petitioner is in custody since 21.02.2019. Till date, according to the instructions of the learned counsel for the petitioner, not a single witness has been examined.

Regard being had to the nature of accusation, attendant circumstances and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. VI, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No. 690 of 2018.

The court below shall release the petitioner on bail only if the aforesaid statement on behalf of the petitioner that no witness has till now been examined, is found to be correct.

In case the petitioner is released on bail, he shall participate in the trial and his absence in the trial proceedings on two consecutive occasions without permission from the trial court, would render the bail granted to him liable to be cancelled. The petitioner shall never try to intimidate anyone of the witnesses or tamper with the evidence. Should he be found doing so, it would be open for the prosecution to file necessary application for cancellation of his bail.
