Let the defect(s), if any, be removed within a period of four weeks.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 326, 302 of the Indian Penal Code and Section 27 of the Arms Act.

Learned Senior Counsel for the petitioner submits that petitioner is a person with clean antecedent. The informant instituted the present FIR against nine named accused persons and 10-12 unknown accused persons alleging that Chandan Kumar shot the nephew of the informant. Learned Senior Counsel for the petitioner submits that

No.7795 of 2022(2) dt.30-08-2022 2/2 from bare perusal of the allegation as alleged in the FIR, it would manifest that there is specific allegation of killing the nephew of the informant against Chandan Kumar and as far as the petitioner is concerned, he is similarly situated like accused Ashish Kumar who was granted anticipatory bail vide order dated 16.06.2022 passed in Cr. Misc. No. 68408 of 2021. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned Senior Counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kasim Bazar P.S. Case No. 70 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
