The present application has been filed for modification of order dated 25.01.2022 passed in Cr. Appeal (SJ) No.4655 of 2019, to the extent of extending the period of surrender. It is submitted that on 25.01.2022, Cr. Appeal (SJ) No.4655 of 2019 was dismissed as withdrawn, after some arguments, with a direction to surrender before the learned court below and seek regular bail but the petitioner could not surrender within time as he suffered from Jaundice and time of six weeks got expired.
Patna High Court CR. MISC. No.20573 of 2023(2) dt.05-04-2023 2/2 On the grounds mentioned in the modification application and in the interest of justice, the period to surrender and seek regular bail is extended by four weeks from today, in connection with Gopalganj SC/ST P.S. Case No.198 of 2019, pending in the court of learned 1st Additional Sessions Judge, Gopalganj, subject to deposit of Rs.2000/- (Rs. Two Thousand) in the Victim Compensation Fund, Bihar.
Rest of the order shall remain intact.
The order dated 25.01.2022 of Cr. Appeal (SJ) No.4655 of 2019 is modified to the extent as indicated above. Accordingly, this modification application stands disposed of.
