JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Isuapur P.S. Case No. 258 of 2019 registered for the offence punishable under Sections 420, 467, 468, 471, 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Allegation as per F.I.R. is of recovery of huge quantity of liquor from TATA-407 vehicle and it is said that petitioner was working as liner.

Submission of the learned counsel for the petitioner is that F.I.R. itself shows that nothing has been recovered from his possession. He has no criminal antecedent, is in custody since 19.12.2019 for more than two months.

Having heard both sides, in view of the facts and

No.8170 of 2020(3) dt.20-02-2020 2/2 circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise- Saran, Chapra, in connection with Isuapur P.S. Case No. 258 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
