This is a petition for grant of regular bail in a case under Sections 395 and 397 of the Indian Penal Code. The First Information Report has been registered against seven unknown accused.
Learned counsel for the petitioner submits that the petitioner has been named by the other co-accused, namely, Akhilesh Kumar in his confessional statement and the petitioner is in jail custody since 04.03.2015. He further submits that neither the Test Identification Parade has been conducted nor any recovery has been made from the possession of the petitioner.
Hence, having regard to the facts and
Patna High Court Cr.Misc. No.49504 of 2015 (2) dt.05-02-2016 circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Rohtas at Sasaram in connection with Session Trial No. 319 of 2015 arising out of Dinara P. S. Case No. 353 of 2014, subject to the condition that the petitioner will file Hazri in the nearest police station once in fortnight for one year and shall not involve in such type of activity in future and if any report is received regarding his involvement then the bail bond of the petitioner shall be cancelled by the Court below.
