JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 15-02-2017 This application under Section 482 of the Code of Criminal Procedure has been filed for modification of the order of this Court dated 03.11.2015 passed in Cr. Misc. No. 49378 of 2015 whereby the petitioner was granted anticipatory bail under Section 438 of the Code of Criminal Procedure and was directed to surrender before the court below within four weeks from the date of order.
It is submitted that since the petitioner was working at Doha, Quatar in a private company and the company was not sanctioning the leave, he could not come to India and surrender before the court below within the period stipulated in the order. The plea of the petitioner for seeking modification
Patna High Court Cr.Misc. No.418 of 2017 (2) dt.15-02-2017 2 / 2 of the order cannot be accepted in view of the fact that no such plea was made when the application for grant of anticipatory bail was being considered by this Court more than a year ago. Accordingly, the application is rejected.
However, the petitioner may surrender and seek regular bail. In case the petitioner surrenders before the court below, it shall take into consideration the fact that earlier this Court has found his case fit for grant of anticipatory bail. (Ashwani Kumar Singh, J.) Sanjeet/- U T
