JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Barbigha PS Case No. 243 of 2014 and NDPS Case No.02 of 2015 for the alleged offences punishable under Section 20(A) (B) of NDPS Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 6.8.2015. He further submits that the institution of the present FIR is motivated at the instance of one Lala Prasad. Referring to the FIR, it is contended that the allegations are completely vague and do not constitute any offence against the petitioner under the provisions of the NDPS Act, 1985. Considering the submission as above, this application is allowed.

Let the petitioner above named, be released on bail

Patna High Court Cr.Misc. No.47720 of 2015 (2) dt.09-11-2015 2/2 on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Sheikhpura in Barbigha PS Case No.243 of 2014 and NDPS Case No. 02 of 2015.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
